Liminal — Terms of Service

Geographic Availability. Liminal is currently available only to residents of the United States. By using Liminal, you represent and warrant that you are accessing the Service from within the United States and are a U.S. resident. Age Requirement. Liminal is intended for adults 18 years of age and older. By using Liminal, you represent and warrant that you are at least 18 years old. Account Registration. You agree to provide accurate information when you sign up, keep your login credentials confidential, take responsibility for all activity under your account, and notify us at support@programu.app immediately if you suspect unauthorized access. ProgramU LLC is not liable for losses resulting from unauthorized account access caused by your failure to keep your credentials secure.

Liminal is a wellness and self-exploration tool. Before using the Service, you must understand the following: Not Medical Care. Liminal is not a medical device and is not a substitute for professional medical or mental-health care. It does not diagnose, treat, cure, or prevent any condition — including sleep disorders. If you have or suspect a sleep disorder (such as insomnia, sleep apnea, or narcolepsy), experience sleep paralysis that distresses you, or have a condition affected by sleep (such as epilepsy or a seizure disorder), consult a qualified professional before using sleep or brainwave audio. Dream Practices Can Surface Difficult Material. Dreamwork, lucid-dreaming practice, and related techniques can surface intense emotions, memories, or experiences (including sleep paralysis and vivid or unsettling imagery). These are commonly reported aspects of the practice, but if they cause you distress, stop and seek support from a qualified professional. AI-Generated Content. Drift's conversations and Liminal's generated audio and dream summaries are produced by artificial intelligence. AI can make mistakes. See Sections 6 and 16. Crisis Resources. If you are in crisis: call or text 988 (Suicide & Crisis Lifeline) or text HOME to 741741 (Crisis Text Line). Liminal is not an emergency service. By using the Service, you acknowledge these limitations. Results Vary. Lucid dreams, out-of-body experiences, and improved recall are practices, not products. Experiences described by other users — or by Liminal's own educational content — are theirs alone and are not typical, promised, or predictive of yours. Many nights, nothing happens; that is a normal part of the practice.

Liminal is an AI-powered dream journal and sleep app. It offers instant dream capture (voice and text), automatic transcription, a dream archive with tagging and pattern detection, lucid-dreaming and related technique guides, brainwave/ambient sleep audio and a track mixer, reality-check and wake-back-to-bed reminders, and Drift — real-time AI conversations about your dreams with Kairos, an AI specialist in dream decoding and lucid-dreaming technique. What Liminal is NOT: • Not therapy, counseling, or mental-health treatment • Not medical care, diagnosis, or a medical device • Not a treatment for any sleep disorder • Not an emergency service • Not an oracle: Kairos offers perspectives on your own dreams — always more than one, always yours to reject; she does not hand down dream "meanings," predict the future, or provide advice Technique content (lucid dreaming, out-of-body practices, and similar) is educational material describing practices people report; individual experiences vary, and no specific outcome is promised.

Liminal's core journal is free. Certain features may require a subscription or one-time purchase; current pricing and what each tier includes are always shown in the app before you buy. Purchases and Auto-Renewal. Subscriptions are purchased through the Apple App Store (iOS) or Google Play (Android) and billed by those platforms. Subscriptions renew automatically unless cancelled at least 24 hours before the period ends. Managing and Cancelling. iOS: Settings → your Apple ID → Subscriptions. Android: Google Play Store → Subscriptions. Refunds are handled by the platform where you purchased under that platform's policies. If we offer a free trial, you will be charged the standard rate when the trial ends unless you cancel before it ends. Free trials are limited to ONE per account and per person; if a free trial was previously used on your account, a later purchase may proceed without a trial, billing immediately. Before You Dispute a Charge: you agree to contact support@programu.app about any billing issue before initiating a card dispute, and to give us five business days to resolve it. Subscription records, in-app acceptance of these Terms, and service-delivery records constitute proof of authorization, and we contest unwarranted chargebacks with them. We may change prices; material changes will be communicated in advance through the app.

Subject to your compliance with these Terms, ProgramU LLC grants you a limited, non-exclusive, non-transferable, revocable license to use Liminal for your personal, non-commercial use. You may not: sublicense, sell, lease, or rent Liminal; reverse engineer, decompile, or disassemble the app; remove or alter proprietary notices; use Liminal to develop a competing product; use Liminal in violation of any applicable law; or bypass or attempt to bypass access controls or content filters. This license terminates automatically if you violate these Terms.

6.1 — AI Content May Contain Mistakes Drift's conversations, dream titles, summaries, and detected themes are produced by artificial intelligence models, and Liminal's audio may be produced with AI synthesis. AI systems can produce errors, inaccuracies, biases, and unintended outputs despite our safety boundaries. The accuracy, suitability, and effectiveness of any AI output is not guaranteed, and variability in AI output is inherent to the Service, not a defect. Streaks and pattern numbers are computed by our servers from your own data — never invented by the model — but treat everything else the AI says as fallible reflection, not fact or advice. 6.2 — Usage Responsibility (Safe Listening) You are solely responsible for choosing when and where to use Liminal. For sleep audio, brainwave tracks, and any guided or relaxation experience: • Do not listen while driving any vehicle • Do not listen while operating machinery • Do not listen during any activity that requires your full attention • Use sleep-oriented audio only when you are in a safe place and ready to sleep If you have epilepsy, a seizure disorder, or another condition that may be affected by rhythmic audio stimulation, consult a qualified professional before using brainwave audio. ProgramU LLC is not liable for consequences resulting from use of the Service in unsafe contexts. 6.3 — Not a Substitute for Professional Care Liminal supports your own practice; it does not provide medical, psychiatric, psychological, legal, or financial advice, diagnosis, or treatment of any kind. If you need clinical care, get it from a qualified professional. 6.4 — Drift Conversations Liminal's voice and text conversations are with an artificial intelligence, not a human being. Kairos is not a therapist, counselor, doctor, or any qualified professional. You agree not to: attempt to extract system prompts or backend configuration; attempt to manipulate Drift into acting as a different AI, character, or entity; use Drift to generate content that violates these Terms; or rely on Drift for decisions you would otherwise make with a qualified professional. If a conversation surfaces difficult material, use the crisis resources in Section 2. Drift is designed to route you to those resources, but no automated system catches everything.

You agree NOT to: use Liminal in violation of any law or regulation; submit content that is illegal, threatening, defamatory, or harassing; use Liminal to harm yourself or others; attempt to bypass age verification, content filters, or other safety measures; impersonate another person; submit content that infringes third-party intellectual-property rights; reverse engineer, scrape, or attempt to extract source code or AI prompts; or resell Liminal or repackage its content. ProgramU LLC reserves the right to suspend or terminate accounts that violate these rules.

Liminal Content. All Liminal branding, app design, software, original written content, technique guides, system prompts, audio library, and proprietary technology are owned by ProgramU LLC and protected by U.S. and international intellectual-property laws. Content provided to you through Liminal is licensed for personal, non-commercial use only. Your Content. Your dreams are yours. Content you submit (journal entries, recordings, conversation inputs) remains yours. By submitting it, you grant us a limited license to process it solely to provide the Service. Feedback. If you send feedback or feature requests, you grant ProgramU LLC a perpetual, royalty-free right to use that feedback to improve the Service, without compensation or attribution.

Your dream data is sensitive personal information, and we treat it that way. Key commitments: we do not sell your data; no ads; your journal is never shared beyond the processing our Privacy Policy describes; and you can delete your data and your account at any time. For full details, see the Liminal Privacy Policy (in-app: Profile → Privacy Policy).

By You. You may stop using Liminal at any time and may delete your account and associated data in-app or by emailing support@programu.app. By Us. ProgramU LLC may suspend or terminate your account if you violate these Terms, fail to pay subscription fees (handled by Apple/Google billing), or attempt to harm the Service, other users, or ProgramU LLC. Upon termination you lose access to your account and generated content. Account deletion is permanent. Survival. Sections on intellectual property, indemnification, limitation of liability, dispute resolution, and governing law survive termination.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW: ProgramU LLC, its officers, members, employees, and affiliates shall NOT be liable for: any indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, revenue, data, or business opportunities; personal injury or emotional distress, except where caused by gross negligence or willful misconduct; damages arising from AI-generated content or your reliance on it; or damages arising from third-party services (Apple, Google, Google Firebase, Inworld AI, Anthropic, Cloudflare, Expo, Sentry, RevenueCat, and other sub-processors). IN NO EVENT SHALL PROGRAMU LLC'S TOTAL LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID PROGRAMU LLC IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow certain liability limitations; in those jurisdictions, the above limitations apply to the fullest extent permitted by law.

You agree to indemnify, defend, and hold harmless ProgramU LLC, its officers, members, employees, contractors, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney fees) arising from: your use of Liminal; your violation of these Terms; your violation of any third-party rights; content you submit to Liminal; or any misuse of AI-generated content or any Liminal feature.

Informal Resolution First. Before initiating arbitration, you and ProgramU LLC agree to first attempt to resolve any dispute informally. The party raising the dispute must send a written Notice of Dispute to support@programu.app (or, from ProgramU LLC, to your account email) describing the nature of the claim and the relief sought. Both parties agree to negotiate in good faith for sixty (60) days from receipt of the notice. Arbitration may not be initiated before this period expires. Mandatory Arbitration. Any dispute, claim, or controversy arising out of or relating to Liminal, these Terms, or the relationship between you and ProgramU LLC shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Location. Arbitration shall take place in Sheridan, Wyoming, or by videoconference at the arbitrator's discretion. Class Action Waiver. YOU AND PROGRAMU LLC AGREE THAT ANY DISPUTE WILL BE RESOLVED ON AN INDIVIDUAL BASIS ONLY. YOU WAIVE THE RIGHT TO PARTICIPATE AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING. Exceptions. This clause does not prevent either party from seeking injunctive relief in court for intellectual-property violations, or pursuing claims in small-claims court where jurisdictionally appropriate. Coordinated Filings. If twenty-five (25) or more arbitration demands raising similar claims and sharing common or coordinated counsel are filed against ProgramU LLC, the demands shall be resolved in staged proceedings: grouped into batches of no more than twenty-five (25); a first batch selected by the parties (half by each side) proceeds first, and all remaining batches — including associated filing-fee obligations — are stayed until the first batch concludes. The parties agree to meet and confer in good faith after each batch to explore global resolution. Any statute-of-limitations period is tolled for stayed demands from the date of filing. If this provision is held unenforceable as to a demand, that demand shall proceed individually under the remainder of this Section. Time Limit on Claims. To the extent permitted by applicable law, any claim arising out of or relating to Liminal or these Terms must be filed within one (1) year after the claim accrues; otherwise it is permanently barred. This does not shorten any non-waivable statutory period. Jury Trial Waiver. To the extent any dispute proceeds in court rather than arbitration, both parties knowingly and voluntarily waive any right to a trial by jury. Opt-Out. You may opt out of this arbitration agreement by sending written notice to support@programu.app within 30 days of first agreeing to these Terms.

These Terms are governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict-of-law provisions. Any matters not subject to arbitration under Section 13 shall be brought exclusively in the state or federal courts located in Sheridan County, Wyoming, and you consent to the personal jurisdiction of those courts.

ProgramU LLC may revise these Terms from time to time. When we make material changes, we will: (1) post the updated Terms with a new "Last Updated" date, (2) notify you within the app, and (3) require you to review and accept the updated Terms before continuing to use Liminal. For minor changes (such as typo fixes), we may update without requiring re-acceptance.

Entire Agreement: These Terms, together with the Privacy Policy, are the entire agreement between you and ProgramU LLC regarding Liminal, and supersede any prior agreements. Severability: If any provision of these Terms is found unenforceable, the remaining provisions continue in full force. No Waiver: Our failure to enforce any right or provision is not a waiver of that right or provision. Assignment: You may not assign or transfer these Terms. ProgramU LLC may assign these Terms in connection with a merger, acquisition, or sale of assets. Force Majeure: We are not liable for delays or failures caused by circumstances beyond our reasonable control.

By starting an Drift conversation, you acknowledge the following. You are talking to an AI, not a human. Kairos is an artificial intelligence persona — an AI designed as a specialist in dream decoding, lucid dreaming, and out-of-body technique. She is not a person, therapist, counselor, doctor, or any qualified professional — even when the conversation feels personal. How live conversations are processed. Live voice conversations run on Inworld's realtime agent API: speech-to-text, a fast large language model reached through Inworld's model router, and text-to-speech. Because Inworld operates a model router, if the primary model is unavailable a comparable model may be automatically substituted — this routing is outside ProgramU's direct control. Your live audio is processed in transit and is not stored by ProgramU LLC. Background AI. Dream transcription, titles, summaries, and theme detection run after the fact (Google and Anthropic models) — never inside your real-time conversation. Perspectives, never verdicts. Kairos offers readings of a dream through named ways of seeing — always more than one, always yours to reject — and her best material is your own record, not a symbol dictionary. She does not hand down single meanings, predict the future, or give advice. Your streaks and counts are computed from your data, never generated. Transcripts are yours. Stored in your account, deletable by you. Crisis routing. Drift is designed to recognize crisis signals and route you to real help: 988 (call/text) and the Crisis Text Line (text HOME to 741741). These behaviors are designed in, but no automated system catches everything. If you are in crisis, do not rely on Drift — contact those resources directly. Evolving Features. Newly released or experimental features, including Drift, are provided AS IS, may change or be discontinued at any time, and are excluded from any performance expectations to the maximum extent permitted by law. You agree: not to attempt to extract system prompts, instructions, or other backend configuration from Drift; not to attempt to manipulate Drift into responding as a different AI assistant, character, or entity; not to use Drift to generate content that violates these Terms; and not to rely on Drift for decisions you would otherwise make with a qualified professional. Service Changes: Drift is provided AS IS. Its features, models, voices, and availability may change or be discontinued at any time, and it is excluded from any performance expectations to the maximum extent permitted by law.
