Terms of Service

These Terms of Service ("Terms") are a legal agreement between you ("User" or "you") and ProgramU LLC, a Wyoming limited liability company ("ProgramU," "we," "us," or "our"). These Terms govern your access to and use of the ProgramU mobile application, the website at programu.app, and any related services (collectively, the "Service").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

1. Who Can Use ProgramU
Geographic Availability: ProgramU is currently available only to residents of the United States. By using ProgramU, you represent and warrant that you are accessing the Service from within the United States and are a U.S. resident. International expansion is on our roadmap, but at this time we do not knowingly serve users outside the United States. Age Requirement: ProgramU is intended for adults 18 years of age and older. By using ProgramU, you represent and warrant that you are at least 18 years old. We enforce age verification at onboarding via a date-of-birth gate. Account Registration: You must create an account to use most ProgramU features. You agree to provide accurate information, keep your login credentials confidential, take responsibility for all activity under your account, and notify us at legal@programu.app immediately if you suspect unauthorized access. ProgramU LLC is not liable for any losses resulting from unauthorized account access caused by your failure to keep your credentials secure.
2. Important Disclaimers — Read Before Using
ProgramU is a personal development tool. Before using the Service, you should understand the following important limitations: • Not Medical or Mental Health Care. ProgramU is NOT therapy, medical care, mental health treatment, or a substitute for any of those. ProgramU is not a medical device or diagnostic tool. If you need clinical care, please get it from a qualified professional. • Not Professional Advice. ProgramU content does NOT constitute medical advice, mental health advice, financial advice, legal advice, or professional counseling. Always consult qualified professionals for matters requiring expert guidance. • AI-Generated Content. All session content is generated by AI (Anthropic Claude for scripts, Inworld AI for voice). AI can produce errors, inaccuracies, biases, or unintended outputs. Use your own judgment when applying any session to your life. • Hypnosis Safety. Hypnosis sessions induce altered states of awareness. Do not listen while driving, operating machinery, or in any situation requiring alertness. If you have a history of dissociation, seizures, psychosis, or are in active mental health treatment, consult your healthcare provider before using hypnosis features. • Sleep Hypnosis Caveat. Sleep-type hypnosis sessions intentionally do not include a full awakening sequence. Only use them in safe environments when you are ready to sleep. • Wealth and Abundance Content. Sessions about money use identity-level affirmations. They are NOT financial advice and do NOT guarantee specific outcomes. • U.S. Residents Only. ProgramU is currently available only to residents of the United States. Full disclaimers and limitations are detailed throughout these Terms. By using the Service, you acknowledge these limitations. • Results Vary. Experiences or results described by other users are theirs alone and are not typical, promised, or predictive of yours.
3. What ProgramU Is
ProgramU is an AI-powered personal development application that generates personalized audio sessions across four AI-generated formats — Subliminal, Meditation, Hypnosis, and EFT Tapping — plus prebuilt Return to Self resets and live CollectiveU group meditations. ProgramU also offers two long-form programs: ReflectU (identity intake plus Kaion, a named AI guide you can talk with by voice or text — Kaion converses, teaches from ProgramU's identity-reprogramming approach, may offer journal prompts, and can recommend or draft personalized sessions for you) and BeingU (90-day journaling and identity-integration program). ProgramU also includes a freeform Journal you can write in with or without a program. Session content is generated by AI providers (Anthropic Claude for script writing, Inworld for voice synthesis) based on the personal context you provide. ReflectU's live voice and text conversation is generated by a different provider: Google's Gemini model, reached through Inworld's routing infrastructure, with Inworld also providing speech-to-text and text-to-speech for voice calls. See Section 6.5 and Section 19 for the ReflectU AI details. ProgramU is a personal development tool. It is NOT therapy, medical care, professional mental health treatment, or a substitute for any of those. ProgramU is not a medical device or diagnostic tool.
4. Subscriptions and Payments
Subscription Service: ProgramU is a subscription-based service. You may subscribe to ProgramU through Apple App Store In-App Purchase (iOS), Google Play Billing (Android), or Stripe (web app at programu.app). Subscription tiers, pricing, and features are presented at the point of purchase. Auto-Renewal: Your subscription will automatically renew at the end of each billing period (monthly or annually) unless you cancel at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price unless we communicate a price change in advance. Managing Your Subscription: ProgramU's subscription terms (auto-renewal, cancellation, refund policy) apply uniformly across all three platforms; however, the mechanics of cancellation are governed by the platform on which you purchased: • iOS: cancel via Apple Settings → your Apple ID → Subscriptions • Android: cancel via Google Play Store → Subscriptions • Web: cancel via Settings → Subscription within the ProgramU web app or by contacting support@programu.app Free Trials: If we offer a free trial, you will be charged at the standard subscription rate when the trial ends unless you cancel before the trial ends. Trial duration and conversion details are disclosed at signup. Free trials are limited to ONE per account and per person; if a free trial was previously used on your account (on any platform — App Store, Google Play, or web), a later checkout may proceed without a trial, billing immediately. Credits: Paid plans include a monthly credit allowance, and credit packs may be offered for purchase. Credits power generation features; the credit cost of each feature is shown at the point of use. Included monthly credits RESET on your billing anniversary each month and do not roll over or accumulate. Credits from purchased packs persist until used and are not reset. Credits have no cash value, are not transferable or redeemable for money, and expire when your account is deleted. Promotional, referral, earned, and creator-code credits are discretionary, may be subject to caps and eligibility rules disclosed where offered, and may be adjusted, revoked, or clawed back in cases of fraud, abuse, or program manipulation. Refunds: • iOS refund requests are handled by Apple per Apple's policies. Contact Apple Support. • Android refund requests are handled by Google per Google's policies. Contact Google Play Support. • Web (Stripe) refund requests are handled by ProgramU LLC. Contact support@programu.app. Before You Dispute a Charge: You agree to contact support@programu.app about any billing issue before initiating a card dispute, and to give us five business days to resolve it. Subscription records, in-app acceptance of these Terms, and service-delivery records constitute proof of authorization, and we contest unwarranted chargebacks with them. Price Changes: We may change subscription prices from time to time. Material price changes will be communicated at least 30 days in advance through the app or by email, and you may cancel before the new price takes effect.
5. License to Use ProgramU
Subject to your compliance with these Terms, ProgramU LLC grants you a limited, non-exclusive, non-transferable, revocable license to use the ProgramU app for your personal, non-commercial use. You may not: • Sublicense, sell, lease, or rent ProgramU • Reverse engineer, decompile, or disassemble the app • Remove or alter any proprietary notices • Use ProgramU to develop a competing product • Use ProgramU in violation of any applicable law • Bypass or attempt to bypass any access controls or content filters This license terminates automatically if you violate these Terms.
6. AI-Generated Content and Session Usage Responsibility
§6.1 — AI-Generated Content ProgramU is an AI-powered tool. All session scripts, BeingU phase content (teachings, morning practices, deep dives, evening integrations), ReflectU outputs, refined focus text, custom affirmation rewrites, suggested resources, and AI-generated sleep practices are produced by artificial intelligence models, including (without limitation) models from Anthropic, Google, and Inworld. Session scripts and ReflectU post-conversation summaries are generated by Anthropic's Claude; ReflectU's live voice and text conversation is generated by Google's Gemini model via Inworld's routing infrastructure (and, if that model is unavailable, a comparable model Inworld's router may automatically substitute); voice synthesis and speech-to-text are provided by Inworld. See Section 6.5 and Section 19. AI systems can produce errors, biases, inaccuracies, and unintended outputs despite our content filters, safety boundaries, and ongoing refinement. The quality, accuracy, suitability, and effectiveness of any individual AI-generated session is not guaranteed. ProgramU is continuously refining the system. The AI models, prompts, content filters, and underlying configurations evolve over time. Content generated today may differ from content generated tomorrow as ProgramU improves. You acknowledge that AI-generated content is inherent to the service and that variability is not a defect. Without limiting the foregoing: ProgramU is not liable for any reliance you place on AI-generated content, including but not limited to identity statements, session content, journaling prompts, affirmations, suggested resources, or any other content delivered through the service. §6.2 — Session Usage Responsibility ProgramU sessions are designed to produce states of relaxation, focus, identity-level reflection, suggestibility, and (in hypnosis sessions specifically) trance. These states can affect your alertness, attention, and awareness. You agree to use ProgramU sessions only in environments where altered states of attention will not endanger you or others. Specifically: (a) You will not listen to any ProgramU session while driving any vehicle. (b) You will not listen while operating machinery of any kind. (c) You will not listen while exercising or performing any physical activity requiring full attention. (d) You will not listen while performing any task where loss of alertness could endanger you or others (e.g., cooking on an active stove, supervising children near water, walking in traffic). (e) Hypnosis sessions specifically induce a trance-like state. You will use hypnosis sessions only when seated or lying down in a safe environment. (f) Sleep hypnosis sessions are designed to guide you into sleep and do not include an awakening sequence at the end. You will use sleep hypnosis sessions only when you are ready to sleep. You are solely responsible for choosing when and where to engage with ProgramU sessions. ProgramU is not liable for any consequence — direct, indirect, incidental, consequential, special, or punitive — resulting from your use of sessions in inappropriate or unsafe contexts. §6.3 — Not a Substitute for Professional Care ProgramU is a personal development tool and is not a substitute for professional medical, mental health, psychological, psychiatric, legal, or financial advice, diagnosis, treatment, or services of any kind. ProgramU sessions are not medical interventions, are not designed to treat any medical or psychological condition, and should not be used as a replacement for professional care. If you are experiencing a mental health crisis, suicidal thoughts, severe anxiety, severe depression, psychosis, dissociation, severe trauma symptoms, or any other condition that requires professional support, please contact a qualified mental health professional or call your local emergency services. In the United States, you can also reach the 988 Suicide and Crisis Lifeline by dialing or texting 988. If you are experiencing a medical emergency, call your local emergency services (e.g., 911 in the United States) immediately. Hypnosis sessions specifically are not recommended for, and you should not use them if you have, a history of: • Seizures or epilepsy • Severe dissociative disorders • Psychotic disorders including schizophrenia • Severe trauma where re-entering altered states could be destabilizing Consult a qualified mental health professional before using hypnosis sessions if you have any condition listed above or any other condition you suspect may make hypnosis inappropriate for you. §6.4 — Wealth and Financial Content Disclaimer ProgramU sessions and BeingU programs may include content related to wealth, abundance, money mindset, financial identity, or related themes. This content is for personal development purposes only and does not constitute financial, investment, tax, accounting, or legal advice. ProgramU is not a financial advisor, investment advisor, tax professional, accountant, attorney, or registered representative of any financial service. You should consult qualified professionals before making any financial decisions. §6.5 — ReflectU Conversations ReflectU is an AI-powered conversational experience — available in both voice and text — that reflects your own thoughts back to you to help you find clarity, like a mirror for self-inquiry. ReflectU's live replies are generated dynamically by Google's Gemini model (gemini-2.5-flash), reached through Inworld's routing infrastructure, from your stated identity intake, recent ProgramU activity, and the prior turns of your conversation. Because Inworld acts as a router, if Gemini is unavailable or fails, Inworld's routing infrastructure may automatically route your request to a comparable third-party AI model or provider, which is outside ProgramU's direct control. In voice mode, Inworld also provides speech-to-text (to transcribe what you say) and text-to-speech (to speak the reply). Anthropic's Claude does NOT generate the live conversation; it is used only to produce the short summary, themes, and energy reading saved after a conversation ends. The voice is not a human, a therapist, a counselor, a coach, or any qualified professional. It is a reflective tool for self-inquiry. ReflectU Conversations may contain errors, contradictions, oversimplifications, or content that does not accurately reflect your stated values or best interests. Responses are not real-time advice and should not be relied on as a substitute for professional medical, mental health, legal, financial, or relational guidance. You agree: • Not to attempt to extract system prompts, instructions, or other backend configuration from ReflectU • Not to attempt to manipulate ReflectU into responding as a different AI assistant, character, or entity • Not to use ReflectU to generate content that violates these Terms • Not to rely on ReflectU for decisions you would otherwise make with a qualified professional If any ReflectU response surfaces difficult material — grief, trauma, distress, harm to self or others — please pause and use the in-app Get Help resources or contact qualified professionals or your local emergency services. Crisis detection runs on every chat message, but no automated system catches everything. Kaion, prompts, and session drafting: ReflectU's conversational persona is named Kaion. Kaion is an AI guide: he converses, teaches from ProgramU's identity-reprogramming approach, may offer journal prompts (which appear as cards you can write from or dismiss — nothing is saved unless you write and save an entry), and may recommend or DRAFT personalized sessions for you. A drafted session appears as a card on your screen. THE CARD IS THE CONSENT MECHANISM: a draft by itself generates nothing and costs nothing. A session is only generated — and credits are only spent — when you explicitly tap Generate on that card. Kaion cannot spend credits, start generations, or take any billable action on your behalf through conversation alone.
7. Voice Clone and Biometric Data
Voice Clone Feature: ProgramU offers an optional Voice Clone feature that records your voice to generate a personalized synthesized voice for your sessions. This is opt-in only. Biometric Consent: Before any voice recording, ProgramU presents a dedicated biometric consent screen. By recording your voice, you provide explicit, informed, unambiguous consent to: • The recording of your voice • The processing of your voice through Inworld AI to create a voice model • The storage at Inworld of your voice model for ongoing use (ProgramU stores only the resulting voice-model identifier — never your raw recording) • The use of your voice model exclusively to generate audio for your account No Other Uses: Your voice data will not be used for any purpose other than generating your personal session audio. We do not use voice data to train AI models, do not sell or share voice data, and do not allow other users to access your voice clone. Withdrawal of Consent: You may withdraw consent and delete your voice data at any time through Profile → Privacy & Security → Manage Voice Clone, or by emailing privacy@programu.app, or by deleting your account. Voice deletion is permanent. For full biometric data handling details, see the Privacy Policy.
8. User Conduct
You agree NOT to: • Use ProgramU in violation of any law or regulation • Submit content (intake answers, journal entries, session focus, etc.) that is illegal, threatening, defamatory, harassing, or sexually explicit • Use ProgramU to harm yourself or others • Attempt to bypass age verification, content filters, or other security measures • Use ProgramU to harass or impersonate another person • Submit content that infringes on third-party intellectual property rights • Reverse engineer, scrape, or attempt to extract source code or AI prompts from ProgramU • Resell ProgramU or repackage its content ProgramU LLC reserves the right to suspend or terminate accounts that violate these conduct rules.
9. Intellectual Property
ProgramU Content: All ProgramU branding, app design, software, original written content, system prompts, and proprietary technology are owned by ProgramU LLC and protected by U.S. and international copyright, trademark, and other intellectual property laws. Generated Content: Audio sessions, scripts, and other content generated for you through ProgramU are licensed to you for personal, non-commercial use only. You may listen to, save, and reflect on this content for personal benefit. You may not redistribute, resell, sublicense, or commercially exploit any AI-generated content from ProgramU. User Content: Content you submit (intake answers, journal entries, session focus inputs, voice recordings) remains yours. By submitting it to ProgramU, you grant us a limited license to process it for the purpose of providing the Service. Feedback: If you provide feedback, suggestions, or feature requests, you grant ProgramU LLC a perpetual, royalty-free right to use that feedback to improve the Service without compensation or attribution.
10. Privacy and Data Handling
Your privacy is important to us. Our Privacy Policy describes in detail what information we collect, how we use it, and your rights regarding your data. Key points: • We do not sell or share your personal data with advertisers • We do not train AI models on your data • You can delete your account and all associated data at any time • We treat voice biometric data and journal content with heightened care For full details, see our Privacy Policy at programu.app/privacy or in the app at Profile → Privacy & Security → Privacy Policy.
11. Account Termination
Termination by You: You may stop using ProgramU at any time. To delete your account and all associated data: Profile → Privacy & Security → Delete Account, or email privacy@programu.app. Termination by Us: ProgramU LLC may suspend or terminate your account if you: • Violate these Terms • Engage in conduct prohibited under Section 8 • Fail to pay subscription fees (handled by Apple/Google billing systems) • Attempt to harm the Service, other users, or ProgramU LLC Upon termination, you lose access to your account and all generated content. Account deletion is permanent. Survival: Sections relating to intellectual property, indemnification, limitation of liability, dispute resolution, and governing law survive termination.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW: ProgramU LLC, its officers, directors, employees, and affiliates shall NOT be liable for: • Any indirect, incidental, special, consequential, exemplary, or punitive damages • Loss of profits, revenue, data, or business opportunities • Personal injury or emotional distress, except where caused by gross negligence or willful misconduct • Damages arising from AI-generated content (including hypnosis sessions, wealth/abundance content, identity reprogramming content) • Damages arising from Voice Clone misuse, unauthorized access, or compromise • Damages arising from third-party services (Apple, Google, Stripe, Anthropic, Inworld, Firebase, Cloudflare, RevenueCat, Resend, Sentry, and other third-party services) IN NO EVENT SHALL PROGRAMU LLC'S TOTAL LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID PROGRAMU LLC IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow certain liability limitations, in which case the above limitations apply to the fullest extent permitted by law.
13. Indemnification
You agree to indemnify, defend, and hold harmless ProgramU LLC, its officers, directors, employees, contractors, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney fees) arising from: • Your use of ProgramU • Your violation of these Terms • Your violation of any third-party rights (including intellectual property and privacy rights) • Content you submit to ProgramU • Any misuse of Voice Clone, AI-generated content, or any ProgramU feature
14. Dispute Resolution and Arbitration
Informal Resolution First: Before initiating arbitration, you and ProgramU LLC agree to first attempt to resolve any dispute informally. The party raising the dispute must send a written Notice of Dispute to legal@programu.app (or, from ProgramU LLC, to your account email) describing the nature of the claim and the relief sought. Both parties agree to negotiate in good faith for sixty (60) days from receipt of the notice. Arbitration may not be initiated before this period expires. This requirement is a condition precedent to arbitration, and the arbitrator shall dismiss without prejudice any demand filed before it is satisfied. Mandatory Arbitration: Any dispute, claim, or controversy arising out of or relating to ProgramU, these Terms, or the relationship between you and ProgramU LLC shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Location: Arbitration shall take place in Sheridan, Wyoming, or by videoconference at the arbitrator's discretion. Class Action Waiver: YOU AND PROGRAMU LLC AGREE THAT ANY DISPUTE WILL BE RESOLVED ON AN INDIVIDUAL BASIS ONLY. YOU WAIVE THE RIGHT TO PARTICIPATE AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING. Exceptions: This arbitration clause does NOT prevent either party from: • Seeking injunctive relief in court for intellectual property violations • Pursuing claims in small claims court (where jurisdictionally appropriate) Coordinated Filings: If twenty-five (25) or more arbitration demands raising similar claims and sharing common or coordinated counsel are filed against ProgramU LLC, the demands shall be resolved in staged proceedings: they shall be grouped into batches of no more than twenty-five (25); a first batch selected by the parties (half by each side) shall proceed first, and all remaining batches — including associated filing-fee obligations — shall be stayed until the first batch concludes. The parties agree to meet and confer in good faith after each batch to explore global resolution. Any statute-of-limitations period is tolled for stayed demands from the date of filing. If this provision is held unenforceable as to a demand, that demand shall proceed individually under the remainder of this Section. Time Limit on Claims: To the extent permitted by applicable law, any claim arising out of or relating to ProgramU or these Terms must be filed within one (1) year after the claim accrues; otherwise it is permanently barred. This does not shorten any non-waivable statutory period. Jury Trial Waiver: To the extent any dispute proceeds in court rather than arbitration (under the exceptions above), both parties knowingly and voluntarily waive any right to a trial by jury. Opt-Out: You may opt out of this arbitration agreement by sending written notice to legal@programu.app within 30 days of first agreeing to these Terms. Opting out does not affect any other provisions of these Terms.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions. Any matters not subject to arbitration under Section 14 shall be brought exclusively in the state or federal courts located in Sheridan County, Wyoming, and you consent to the personal jurisdiction of those courts.
16. Changes to These Terms
ProgramU LLC may revise these Terms from time to time. When we make material changes, we will: 1. Post the updated Terms at programu.app/terms with a new "Last Updated" date 2. Notify you within the app 3. Require you to review and accept the updated Terms before continuing to use ProgramU For minor changes (such as typo fixes), we may update without requiring re-acceptance. The current version is always at programu.app/terms.
17. Miscellaneous
Entire Agreement: These Terms, together with the Privacy Policy and any other policies referenced, constitute the entire agreement between you and ProgramU LLC. Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions remain in full effect. No Waiver: Failure by ProgramU LLC to enforce any right or provision does not constitute a waiver of that right. Assignment: You may not assign these Terms. ProgramU LLC may assign these Terms to a successor entity (e.g., in connection with a merger, acquisition, or sale of assets) without notice. Force Majeure: Neither party is liable for delays or failures caused by events beyond reasonable control (natural disasters, war, terrorism, internet outages, third-party service failures, etc.). Apple App Store and Google Play Store compliance: If you accessed ProgramU through the Apple App Store, your use of ProgramU on iOS is also subject to Apple's Media Services Terms and Conditions and the App Store's Standard EULA. Apple's terms govern your relationship with Apple regarding your iOS use of the app. If you accessed ProgramU through the Google Play Store, your use of ProgramU on Android is also subject to Google Play's Terms of Service and Google's terms governing the Play Store. Google's terms govern your relationship with Google regarding your Android use of the app. If you accessed ProgramU through the web app at programu.app, your use is governed solely by these Terms and ProgramU's Privacy Policy. In-app purchases: • iOS in-app purchases are processed by Apple under Apple's terms. • Android in-app purchases are processed by Google under Google's terms. • Web app purchases are processed by Stripe under Stripe's terms. You acknowledge that these Terms are between you and ProgramU LLC, NOT Apple, Google, or Stripe. Apple and Google have no obligation to provide maintenance or support services. Apple and Google are third-party beneficiaries of these Terms with the right to enforce them against you.

19. ReflectU AI Conversations
ReflectU is an AI-powered conversational experience whose persona is named Kaion. You are interacting with an artificial intelligence, not a human being. ReflectU is a reflective tool — an AI designed to reflect your own thoughts back to you to help you find clarity and facilitate insight; it is not a real person, therapist, or any actual version of you. ReflectU conversations are processed in real-time by third-party AI providers. The conversational responses (both voice and text) are generated by Google's Gemini model, reached through Inworld's routing infrastructure; if Gemini is unavailable, Inworld's router may automatically substitute a comparable third-party AI model or provider. In voice mode, Inworld also transcribes your spoken audio (speech-to-text) and synthesizes the reply (text-to-speech). By starting a session, you consent to your conversation content — and, in voice mode, your spoken audio — being transmitted to and processed by these providers. Your live-call voice audio is transmitted to Inworld only to be transcribed for the conversation; it is not used to create a voiceprint, is not used to train any model, and is not retained by ProgramU. ProgramU does not currently have a Zero Data Retention agreement with Inworld or the routed model provider. Please review Inworld's privacy policy at inworld.ai/privacy for details on how conversation data is processed and retained, and see Section 14 of our Privacy Policy for the full ReflectU data flow. ReflectU is not therapy, not medical advice, and not a substitute for professional mental health care. ReflectU conversations may contain errors, omissions, or content that does not match your best interests.
